Welcome to WashedUp. By creating an account or using our platform (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use WashedUp.
Zero Tolerance for Abuse
WashedUp has a strict zero tolerance policy for abusive or objectionable content. We do not allow: harassment, hate speech, discrimination, bullying, spam, or any content that violates our Community Guidelines. Users who post such content or engage in abusive behavior will have their content removed and their accounts suspended or banned. We review all user reports within 24 hours and take action accordingly.
1. Eligibility
You must be at least 18 years old to use WashedUp. By using the Service, you confirm that you are 18 or older and have the legal capacity to agree to these Terms. We reserve the right to terminate the account of any user who misrepresents their age or is discovered to be under 18.
2. User Accounts
You are responsible for keeping your WashedUp account secure. Do not share your password or account with others. You are responsible for all activity that occurs under your account. Notify us immediately at hello@washedup.app if you suspect your account has been accessed without authorization. We may require account verification via email or phone to prevent abuse.
3. User-Generated Content
You retain ownership of all content you post on WashedUp (including plans, messages, photos, profile information, etc.). By posting content, you grant WashedUp a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content to provide the Service. You agree not to post content that is:
- Harassing, threatening, or bullying toward others
- Hate speech or discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or other protected characteristics
- Sexually explicit, pornographic, or obscene
- Promoting illegal activities (including drug use or violence)
- Spam, scams, unauthorized advertising or solicitation
- Infringing the intellectual property rights of others
- Containing malware, viruses, or harmful code
- Impersonating another person or entity
(See our Community Guidelines for detailed rules.) If you violate these rules, we may remove your content and suspend or terminate your account.
4. Content Moderation
We reserve the right to remove any content that violates these Terms or our Community Guidelines at our sole discretion. We are not obligated to monitor all content, but we may do so. If you see content that you believe violates our rules, report it to hello@washedup.app. We will investigate and take action as needed. We may also use automated tools and human moderation to enforce these policies.
5. Events and Real-World Meetups
WashedUp only facilitates user-to-user connections for local events. We do not organize, host, or supervise any events. Users create and join meetups at their own discretion. You are solely responsible for your safety and behavior at any event or meetup. WashedUp does not verify the identity, background, or intentions of any user. We encourage you to exercise caution: meet in public places, tell someone where you’re going, and use common sense when meeting new people.
6. No Warranties; Limitation of Liability
Disclaimer: WashedUp is provided “as is” and “as available,” without any warranties of any kind, whether express or implied. We do not guarantee the Service will meet your needs or be uninterrupted or error-free.
Limitation of Liability: To the fullest extent allowed by law, WashedUp (including its founders, officers, and employees) shall not be liable for any damages arising from your use of the Service. This includes direct, indirect, incidental, consequential, or punitive damages. Specifically, we are not liable for any disputes, injuries, or damages that occur between users, whether online or at in-person events. In no event will our total liability to you exceed the greater of (a) the amount you have paid us in the 12 months before a claim, or (b) $100. You agree that any claims against WashedUp are subject to these limits.
7. Indemnification
You agree to defend, indemnify, and hold harmless WashedUp PBC and its affiliates (including owners, officers, employees, and agents) from any claims, losses, liabilities, damages, and expenses (including attorneys’ fees) arising out of or related to your use of the Service, your content, your breach of these Terms, or your conduct at any event or meetup. This includes claims based on your own negligence or willful misconduct.
8. Account Deletion and Termination
You may delete your WashedUp account at any time. We have provided mechanisms in the app and on our website so you can terminate your account and remove your information. When you delete your account, we will remove your personal data in accordance with our Privacy Policy. We may also suspend or terminate your account at any time if you violate these Terms or our Community Guidelines, or for any reason at our sole discretion. If we terminate your account, you may lose access to your content and data.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service or legal requirements. If we make material changes, we will notify you via email or in-app notice. Your continued use of WashedUp after any changes are posted constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any disputes arising from these Terms or your use of WashedUp must be resolved in the state or federal courts located in Los Angeles County, California.
